$1,300,000 Recovery for Contested Case Premises Liability
- Our client, a college student, was a guest at the defendant’s home attending a birthday party. He sustained a severely broken leg when the deck he was standing on collapsed from house to the ground. He had to undergo several surgeries but fortunately made a full recovery. The homeowner contested both liability and damages. We proved lack of safety inspection and maintenance of the deck structure which would have prevented the collapse.
$750,000 Award for Slip and Fall Accident (Bethesda, MD)
- Our client was a 48-year-old woman who entered an ice cream store in Bethesda, Maryland. The floor was wet, but there were no signs or warnings. She slipped and fell on the wet area, falling forward and striking her head and injuring her low back. The force of the impact was so strong that several of her front teeth were fractured, but her main injury was to her lower back, where she previously had had a surgery. The store originally contested liability, and contested only the extent of her injury and claimed it was the result of her original back injury. After a new surgery, she made a full recovery. The original offer was $300,000. The case was placed into litigation by our firm, and the award was over $750,000. Needless to say, our client and her family were very pleased.
$677,000 Award for Construction Accident (Washington, D.C.)
- The firm obtained an award of $677,000 when the client, working as a pipefitter, fell two stories through the floor of a multi-story building under construction in the District. Another contractor had weakened the flooring to its breaking point by rolling heavy equipment over the area repeatedly causing it to weaken in order to do its work, but did not reinforce the floor. The contractor and others were previously instructed on several occasions not to transport heavy equipment over the area, but continued to do it. Our client broke his ankle in several places and tore his bicep, and also suffered other injuries including a concussion. The defense argued that our client knew the area was unsafe before the fall.
$260,000 Settlement Against Operator of After-School Child-Care Program for Broken Leg (Montgomery County, Maryland)
- Our client, a 9-year-old boy, was injured when a stack of metal chairs in a playroom fell on top of him and broke his leg and knocked out 2 teeth. The insurance company and operator tried to argue that the children were instructed not to climb on chairs even though they were placed right in the middle of the room. Our position was, “what do you expect little boys to do when they are in a play room?” The operator admitted that the room was not inspected for potential hazards to the children before the accident, and it would usually store chairs in a closet. Finally, we found out that the room was being used as a substitute for the playground on the day of the accident because the weather was bad outside where the kids would usually run and play.
$265,000 Award Against Landlord of Apartment Complex, Slip and Fall (Montgomery County, Maryland)
- Our client was awarded $265,000 for injuries to her neck, head, and lower back after she slipped down a row of stairs in a common hallway of the building after they had been mopped, but no signs or warnings were put up. The landlord tried to claim that our client should have seen the liquid on the floor, but videotape of the event and a witness who came to the scene right after the fall contradicted this claim.
$207,000 Settlement Against Walmart, Where Client Slipped and Fell on Wet Area and Injured Her Knee (Fairfax, Virginia)
- A riding floor sweeper/mopper leaked water on the floor several minutes before our client was in the area. Our client slipped and fell and injured her knee when she stepped on the soapy liquid, requiring surgery.
$175,000 Award Against Convenience Store-Dollar Tree (Montgomery County, Maryland)
- Our client was a woman who tripped over a leg of a magazine stand that was sticking out into the aisle near the check-out. She sustained a torn rotator cuff and knee injury. The store and insurance company denied liability, arguing that the rack was not sticking out into the path. Video and photos we obtained, showed that it was, and it was not easily seen by people walking in the area.
$300,000 Award to 85-Year-Old Gentleman Rear-Ended in Bethesda (Montgomery County, Maryland)
- Our client was waiting at a stoplight when the defendant smashed into the rear of his car. Our client had a previous history of back injury and surgery only a year before, but then had to undergo another surgery due to the accident. The insurance company tried to blame the previous condition for our client’s injuries.
$216,000 Settlement Against Grocery Store (Prince George’s County, Maryland)
- Our client was a woman who was leaving a popular chain grocery store, when she slipped and fell on a powdery substance near the checkout register. The store denied that there was anything on the floor and claimed it conducted regular safety inspections of the area. But after we obtained the videotape of the area and the incident, we found that it showed store employees wiping up the area several times after the fall and a substance on the towels, not to mention that no employee inspected the area for over an hour before the incident.
$610,000 Award for College Student Struck in Crosswalk (Virginia)
- Our client was a freshman at a well known college in Virginia. While going to class one morning, she was struck in a crosswalk by a speeding car being driven by another student. She was thrown over 50 feet in the air and landed on the pavement. Liability was hotly contested by the defendant driver, as he claimed that our client ran out into the street without looking. Our client had a head injury, fractured ribs, a broken arm and collarbone, and various other injuries. Luckily, she made a great recovery and we are glad she was able to return to her school and complete her education.
$400,000 Settlement for Slip and Fall Victim (Prince George's County, Maryland)

- Our clients were the parents of a 26-year-old, severely autistic young man who was placed into a home allegedly designed to provide skilled and compassionate care to the disabled. One evening, a nurse/caregiver lost his patience and started punching and kicking our client, causing injury to his eye as well as emotional trauma. We sued the operator of the home and the staff member. After they denied liability, we deposed the principals of the company and found the level of care and supervision was substandard and that the homes were understaffed. We also discovered a video of the incident, which showed the staff member lost control and did not comply with safety protocols. The case resolved shortly thereafter, and the money went towards setting up a fund for the son to assist with his care.
$290,000 Slip and Fall Settlement (Montgomery County, Maryland)
- Our client was a 62-year-old woman who slipped and fell on ice in the parking lot of an office building in Gaithersburg, Maryland. As a result of the fall, she broke her kneecap and had to undergo two surgeries. She was in excellent health at the time of the accident. She sustained some permanent loss of function in her knee and right leg. Our investigation found that there were watering bags placed around several newly planted trees near the area, and we believed that water had leaked from the bags, ran off into the parking area and froze overnight, creating a slipping hazard. She fell the next morning after temperatures had fallen below freezing and the water froze. We sued the owner of the building. The original offer was $85,000. After we filed suit, the case settled for $290,000.00.
$272,000 Auto Accident Settlement (Montgomery County, Maryland)
- Our client was driving home from work when the defendant's work truck crossed the center line of the road and hit our client's vehicle head-on (see our video). Our client was taken to Shock Trauma by helicopter. He had a concussion, a torn meniscus in his knee, which required minor surgery, and later developed a blood clot due to the procedure. Fortunately, everything turned out fine. He had about $11,000 in medical bills and over $25,000 in lost wages. The case settled shortly before trial.
$265,000 Slip and Fall Settlement (Arlington, Virginia)
- Our client was a 34-year-old woman who fell walking at the base of a stairwell on two winder stairs that turned to the right leading into the basement of a home being shown for sale. At the location of the stairway where our client fell, there was no handrail. She broke her foot and ankle and had to have surgery to set the bone. She was also out of work for 5 months, but made a full recovery. The homeowner’s defense was that he had bought the home in that condition (incomplete handrail) and that the home had passed previous inspection. The case was hard fought and the original offer was $75,000. After suit was filed and discovery was conducted by the insurance company and our team, the case settled for $265,000.00.
$185,000 Auto Accident Settlement (Rockville, Maryland)
- Our client was a 92-year-old woman, whose car was struck by another vehicle that ran a stop sign at Leisure World. The client suffered a spiral fracture of her right arm. She was in excellent health at the time of the accident and still self-sufficient. She had surgery to repair the fracture and have a plate and screws inserted into her arm. She was in a rehab facility for 2 months and lost some mobility in the arm. The insurance company argued that due to her age, her mobility, etc., was already limited, and that because she was over 90, that her life expectancy was short, and therefore her long-term pain and suffering was minimal (really; how touching!). Its last offer was around $85,000 although it knew its driver was at fault and she had spent several weeks in a rehab home after surgery. The case settled after a suit was filed for over $100,000 above the last offer.
$175,000 Settlement for Car Accident Victim (Maryland)
- Our law firm obtained a $175,000 settlement award in a legal case against the State of Maryland for a woman whose car was hit by a Maryland State Police Trooper. Our client had $12,000 in medical bills for a neck injury sustained in the car accident. Three other law firms declined the case.

- We recovered $115,000 for an 86-year-old woman who tripped and fell over a table leg in a nursing home dining area, resulting in a fracture to her arm.
$105,000 Settlement for Baltimore Woman: Trip and Fall (Baltimore, Maryland)
- Attorney Plotnick obtained a settlement of $105,000 for a 70-year-old woman who fell outside of a restaurant after tripping over a piece of rope that was tied to a row of garbage cans being used as a makeshift construction barrier. Our client was walking on the sidewalk near the restaurant, going to her car after she and her husband had finished dining. There was construction being done at the restaurant building. However, instead of putting up orange cones or warning tape, the property owner and construction company simply lined up several trash cans and tied them together with a piece of rope to keep people out. There were no signs. It was around 9 p.m. and the area was not well-lit. While our client was walking on the sidewalk, she tripped over the rope, fracturing her kneecap. Her leg had to be immobilized for several weeks, and she had to undergo intensive physical therapy. Her medical bills were approximately $13,000.

The defendant argued that the shoulder injury was from an incident 5 years prior. There was no evidence that our client was having any issues with her shoulder before this accident. The case settled after the testimony of the defense doctor showed he could not support this claim. Our client had $11,000 in medical bills and $8,400 in lost wages.
$99,500 Auto Accident Settlement Involving Drunk Driver (Fairfax, Virginia)
- Our client was coming from work early in the evening on Fairfax Parkway when she slowed for traffic ahead. She was then struck from behind by an intoxicated/drunk driver, who was arrested at the scene. Fortunately, her injuries were minimal, but because our investigation found that the other driver had several violations for drunk driving in the last 10 years, he was subject to potential punitive damages. This evidence was presented to the insurance company, who then agreed to pay a much higher value for the claim.
$109,000 Settlement for Patient/Resident of Nursing Home Assaulted by Staff Member (Rockville, Maryland)
- Attorney Plotnick obtained a settlement of $95,000 for an elderly patient/resident of a nursing home who sustained two broken fingers when a nurse pushed him to the floor trying to gain control of him. The client tried to brace his fall with his right hand and suffered the fractures during the fall. The original offer from the nursing home was $12,000.
$95,000 for Man Injured in Tractor-Trailer Accident (Frederick, Maryland)
- Attorney Plotnick obtained a settlement of $95,000 for a man whose vehicle was hit by a tractor-trailer in Allegany County, Maryland. The tractor-trailer was traveling at a high rate of speed and hit our client's truck from behind, forcing it off on the road and onto its side. Our client was lucky in only suffering a concussion, bumps and bruises, and a sprain to his back and neck. During our investigation, we found that the driver of the tractor-trailer had several recent citations for unsafe driving. Our client was taken by ambulance to a nearby Maryland hospital. He returned to his home state of Louisiana, where he completed his therapy. We are glad to report he is now back on the road. His medical bills were approximately $14,000.
